ORDER

The petitioner purchased 0.03 acres out of 1.27 acres comprised in S.F.No.986 in Re Survey No. J/11/102 & 99, Udhagamandalam Town, by virtue of Sale Deed, dated 11.11.2007. The petitioner applied for building plan approval to the second respondent/Udhagamandalam Municipality in the said property. He also obtained No Objection Certificate from the District Forest Officer and Geo Tech and Agricultural Engineering Department. Since, no building plan approval was given, the petitioner has made a representation to the second respondent/Udhagamandalam Municipality on 23.07.2015. Till date, the said representation has not been disposed of by the second respondent. Hence, the petitioner before this Court.

2. Heard Mr.G.Thyagarajan, learned counsel appearing for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader for respondents 1 and 2.

3. Since, the petitioner applied for building plan approval and the same has not been considered, he gave a representation to the second respondent on 23.07.2015. Admittedly, the said representation has not been considered.

4. In view of the above, without going into the merits of the opinion, this Court directs the second respondent to consider the petitioner's representation and pass orders within a period of two weeks from the date of receipt of a copy of this order.
