PRAYER: Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to issue a no objection certificate to the petitioner to run a "SPA" i.e. cross massage in the name and style of "MONALISA BEAUTY SPA" at Srinivasa Colony, Ranga Nagar, Suramangalam, Salem - 636005, by passing orders of the petitioners representation dated 15.07.2021.

O R D E R

This petition has been filed to direct the 2nd respondent to issue a no objection certificate to the petitioner to run a "SPA" i.e. cross massage in the name and style of "MONALISA BEAUTY SPA" at Srinivasa Colony, Ranga Nagar, Suramangalam, Salem - 636005, by passing orders on the petitioners representation dated 15.07.2021.

It is seen that the petitioner, who had sent a representation to the Superintendent of Police, Salem on 15.07.2021, filed this Writ Petition on 16.07.2021, even before ascertaining whether the representation of the petitioner had reached the Superintendent of Police and whether any steps have been taken by initially. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Government Advocate (Crl.Side) has submitted that, it is the regular practice of some counsel to file such petitions without giving sufficient time for the representation to be acted upon, and thereafter, obtain orders from this Court and by using the same pressurize the concerned officials to grant license.

4. It is brought to the notice of this Court that it is such a similar case. In view of the same, this Court is not inclined to entertain this petition, and the petitioner is directed to move a fresh petition after his representation is dealt with.

5. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is also closed.
