Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent herein to consider the representation dated 08.05.2015 to post the the petitioner as a State Maternal and Child Health Officer. For Petitioner :

2. The petitioner was appointed as a Staff Nurse at Government K.G.H. Hospital, Chennai on 11.02.1983 and on 12.09.1988 got appointment as a Public Health Nurse, which was later re-designated as Maternal & Child Health Officer (MCHO). The petitioner got promotion as Health Educator Training Officer on 26.2.2007

3. The petitioner on 12.08.2014, submitted a representation to consider his claim for the post of State Maternal and Child Health Officer for the reasons that she is the senior most and qualified person of the said post and without considering her claim, six persons have been promoted as Joint State Maternal and Child Health Officer, who are admittedly juniors to the petitioner. The petitioner has also submitted a reminder dated 08.05.2015 and though it was received and acknowledged, no response is forthcoming and hence, came forward to file this writ petition.

4. Heard the submissions of Mr.Mr.S.Wilson, learned counsel appearing for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents.

5. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the respondents 1 and 2 to consider and dispose of the petitioner's representation dated 08.05.2015 on merits and in accordance with law, after putting on notice the persons concerned and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the persons concerned.
