ORDER

This petition is filed for a direction to the respondent police to file the final report u/s.173(1) of Cr.P.C. in Crime No.07/2015 pending on the file of the respondent police within a stipulated time frame on merits and in accordance with law. 2.Today, when the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that the second accused is absconding and further submitted that unless and until he surrender, the investigation cannot be completed and thus, he opposed to give any direction as sought for by the petitioners.

3.Mr.S.Lakshmanasamy, learned counsel appeared for the intervenor.

4.In view of the submissions made by the learned Additional Public Prosecutor, since the second accused is absconding, now this Court cannot entertain the prayer in this petition. Hence, this Criminal Original Petition is dismissed. However, the petitioners are at liberty to approach this Court after the second accused surrender before the Court.
