Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of mandamus to direct the first respondent to pass orders on the petitioner's appeal dated 07.07.2020 against the order of the second respondent issued in Na.Ka.No.304/Mines/2020 dated 29.06.2020 by cancelling the quarrying permission granted, within a time frame fixed by this Court.

2. Mr.E.Manoharan, learned Special Government Pleader takes notice for the respondents.

3. This writ petition is filed directing the first respondent to pass orders on the appeal filed by the petitioner dated 07.07.2020 against the order of the second respondent dated 29.06.2020.

4. It is stated that the petitioner was given quarrying permit by the second respondent on 27.05.2020 and the said permission was subsequently cancelled on 29.06.2020. Challenging the said order of cancellation, the petitioner is said to have filed the appeal on 07.07.2020. The grievance of the petitioner is that the said appeal has not been considered by the respondents so far.

5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the first respondent to consider and decide. Therefore, without expressing any view on the claim made by the petitioner, this Writ Petition is disposed of, only by directing the first respondent to consider the appeal filed by the petitioner dated 07.07.2020 and pass orders on the same on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs. The connected miscellaneous petition is closed.
