ORDER

The petitioner apprehends arrest for the alleged offence under Sections 8(c) r/w 20(b)(ii)(B), 25 and 29(1) of NDPS Act in Crime No.347 of 2024 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 8.580 kgs of ganja. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner was innocent and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that this is the third bail application and the petitioner has three cases pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

6. Considering the facts and circumstances of the case and also considering the totality of the circumstances and upon the fact that the petitioner has three previous cases pending against him and this is a case where 8.580 kg of ganja has been recovered which clearly demonstrates the seriousness of the

offence and the conduct of the petitioner. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.
