This writ petition has been filed by the petitioner to call for the records pertaining to the proceedings of the second respondent in Ref.No.6042/Pers.IR.2/2019 dated 29.05.2020 and quash the same as illegal, incompetent and ultravires and consequently direct the second respondent to re-instate the petitioner in the post of Assistant General Manager, Dharmapuri Cooperative Milk Producers Union.
2. When the matter was taken up for hearing, learned counsel for the petitioner submitted that as against the order passed by the second respondent dated 29.05.2020, the petitioner has preferred an appeal before the first respondent on July 2020.
3. Learned Government Advocate appearing for the respondents Page No.2 of 5
submitted that the competent authority to consider the appeal filed by the petitioner is the Board and the same will be considered by the New Board, which will be constituted after the election and it will take six months time to conduct the election.
4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.
5. In view of the submission made by the learned counsel on either side, the first respondent is directed to consider the appeal filed by the petitioner on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order.
6. This writ petition is disposed of with the aforesaid observation and direction. No costs. Consequently, connected miscellaneous petition is closed.
