(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 28.08.2020 for the offences punishable under Sections 4(1)(aaa), 4(1-A) of Tamil Nadu Prohibition Act r/w Sections 468, 471 & 420 of IPC and Rules 6 & 7 TN Rectified Spirit Rules 2000, in Crime No.757 of 2020, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner was found in illegal possession of 105 liters of Rectified Spirit and 300 empty bottles with sticker of various brands of liquor and the same was seized by the respondent police.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case for statistical purpose.

4.The learned Government Advocate (Criminal Side) would vehemently oppose stating that the petitioner was illegally found in possession of 105 litres of Rectified Spirit and 300 empty bottles with stickers of various brands of liquor and fake holograms and the https://hcservices.ecourts.gov.in/hcservices/

same was seized by the respondent police. Apart from this case, the petitioner has got two previous cases and the investigation is pending.

5.Taking into consideration the fact that the petitioner has got two previous cases against him and that he has been arrested very recently on 28.08.2020, this Court is not inclined to grant bail to the petitioner.

6.This Criminal Original Petition petition stands dismissed accordingly.
