Prayer : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the 1st Respondent to register the petitioner's complaint dated 10.03.2018 in accordance with law.

O R D E R

This petition has been filed to directing the 1st Respondent to register the complaint given by the petitioner dated 10.03.2018.

2.The learned counsel for the petitioner has submitted that the proposed accused person has received a sum of Rs.15,00,000/- as security deposit, for running a quarry business, however, subsequently, he refused to return the said amount to the petitioner and hence the petitioner has lodged a complaint before the first respondent on 10.03.2018, but so far, no action has been taken.

3. The learned Additional Public Prosecutor has submitted that the said complaint is still pending before the first respondent for enquiry.

4.Considering the aforesaid submissions, the first respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he has to register https://hcservices.ecourts.gov.in/hcservices/

a case and proceed further in accordance with law. In case, the enquiry reveals only a civil dispute, the first respondent has to direct the petitioner to approach the appropriate forum and get appropriate relief in accordance with law.

5. With the aforesaid observations, this petition is disposed of. No costs.
