ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 420, 465, 467, 468, 471 and 120B of IPC , in Crime No.62 of 2025, seeks anticipatory bail.

2. According to prosecution, the accused A1 impersonated A2 and executed a sale deed in his name and thereafter executed the sale deed in favour of the present petitioner.

3. The learned counsel for the petitioner submits that the occurrence took place on 08.11.2023 and FIR came to be registered on 23.12.2025. There are about three accused and the present petitioner is so far not arrayed as an accused in Crime No.62 of 2025 and the present application has been filed based on the summons received under Section 35 (3) of the BNSS.

4. The learned Government advocate would fairly submit that so far as the petitioner has not been arrayed as an accused and however he has been served with summon under Section 35 (3) of the BNSS. The learned Government Advocate would further submit that the petitioner was requested to produce certain documents.

Taking into consideration of the totality of the circumstances viz., the occurrence took place on 08.11.2023 and FIR came to be registered on 23.12.2025, this Court is of the view that custodial interrogation of the petitioner is not required for the purpose of investigation. Hence, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

6. Accordingly, this Criminal Original Petition is ordered. The petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy is made ready, before the learned Judicial Magistrate I, Kancheepuram, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that: [a] the petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioners shall report before the Inspector of Police, Central Crime Branch, Tambaram City, Chengalpattu District, twice a day at 10.30 a.m. and 05.30 p.m. for a period of 30 days and thereafter as and when required for interrogation; [c] the petitioner shall not tamper with evidence or witness either during investigation or trial;

[d] the petitioner shall not abscond either during investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
