CMP. No.13283 of 2018 in CMA (SR) No.28937 of 2018 R.MAHADEVAN, J.

This petition is filed by the petitioner / appellant / owner of the vehicle seeking to condone the delay of 1958 days in filing the above Appeal.

2. Heard both sides. The learned standing counsel for R-5 / Insurance Company stated No Objection in ordering this petition.

3. In view of the said submission, having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay of 1958 days in filing the above Appeal is condoned subject to the following condition:- (i) The petitioner / appellant shall pay a sum of Rs.2,000/- as costs to the "Tamil Nadu State Legal Services Authority, Chennai" on or before 06.11.2019 failing which this application shall stand dismissed automatically without further reference to this Court.

4. This petition is ordered accordingly.
