The petitioner, who was arrested and remanded to judicial custody on 25.03.2023 at the hands of the respondent police for the alleged offences punishable under Sections 420 @ 120B, 420, 465, 467, 468 and 471 of IPC in Crime No. 6 of 2022, seeks bail.

The case of the prosecution is that A2/Santhosh Kumar, Sub Inspector of Police, Tamil Nadu Police Department, had offered for getting government job at BSNL/Police Department to the defacto complainant's daughter-in-law. On the pretext, A2 introduced his relative Valli/A1 and both assured to get a job at BSNL and received a sum of Rs.12,00,000/- from the defacto complainant through bank. The said amount was transferred to A3/petitioner's account, viz., Srishanth Enterprises, in the year 2017 through cash and cheque. For which, A1 and A2 had issued fake call letter to the defacto complainant for the post of Junior Accounts Officer in BSNL on 25.05.2018. After due verification, it came to light that the call letter issued by the accused is a bogus one and thus the accused committed cheating. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant of bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that there are totally three accused, in which the petitioner is arrayed as A3. They had collected nearly Rs.7,00,00,000/- from 68 victims in order to get them job at BSNL and in Police Department. The petitioner also collected substantial amount from the victims. They had committed very serious offence as against the victims. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the above circumstances and also taking note of the fact that the petitioner had committed a very serious offence as against the victims, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 04.05.2023 Lpp
