ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to act upon the online application submitted by the petitioner on 06.09.2024, wherein, the petitioner has sought for the survey of the subject property and for demarcation of boundaries.

2.Heard Mr.E.Kannadasan, learned counsel appearing on behalf of the petitioners and Mr.S.Jayachandran, learned Government Advocate appearing on behalf of respondents 1 and 2.

3.The petitioner is relying upon the Sale Deed dated 09.06.2022 registered as Document No.6619 of 2022. The petitioner is also relying upon the

3/6 patta granted in his name in Patta No.6437. The petitioner wanted a survey to be conducted and hence, submitted an online application on 06.09.2024. When the st respondent acted upon the same and came for survey, it was resisted by the rd and 4 th respondents who are the adjacent land owners. The same resulted in giving a complaint to the 2 nd respondent which was enquired as a CSR. Since there was no further progress, the present writ petition has been filed before this Court.

4.Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 1 st respondent to act upon the online application submitted by the petitioner on 06.09.2024 and conduct a survey in the subject property based on the title document and the patta that already stands in the name of the petitioner. Since the 3 rd and 4 th respondents are objecting, such survey shall be conducted in their presence. If the 3 rd and 4 th respondents have any dispute, they must approach the Civil Court and Seek for necessary remedy and they cannot prevent the 1 st respondent from conducting the survey. If required, the 1 st respondent can seek

4/6 for police protection from the 2 nd respondent which shall be provided. This process shall be completed, within a period of four weeks from the date of receipt of copy of this order.
