Heard Mr.Vidyesh representing Mr.T.R.Rajaraman, learned counsel appearing for the petitioners.

2.Being satisfied with the reasons assigned in the affidavit filed in support of the petition, this petition is ordered, the delay of 276 days in filing the petition to set aside the abatement is condoned and the abatement caused due to the death of the 1st appellant is set aside. Subsequently, the respondents 3 & 4 / proposed respondents 3 & 4 in C.M.P.No.7448 of 2023 are brought on record as legal representatives of the 1st appellant and ranked them as respondents 3 & 4 in the Second appeal and the petitioners 3 to 6 / proposed petitioners 3 to 6 in C.M.P.No.7442 of 2023 are brought on record as legal representatives of the deceased 1st appellant and ranked them as appellants 3 to 6 in the Second Appeal.
