Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the representation letter dated 16.04.2018 filed by the petitioner and further directing the respondents 1 to 3 to take departmental action against the 4th & 5th respondents in accordance with law. O R D E R

The prayer sought for in the writ petition is to direct respondents 1 to 3 to consider the petitioner 's representation letter dated 16.04.2018 and further direct the respondents 1 to 3 to take departmental action against the 4th & 5th respondents in accordance with law.

2. No Appearance for the petitioner as well as the respondents 4 & 5. Heard the learned Additional Public Prosecutor appearing for the respondents 1 to 3.

3. It is seen that the petitioner seeks direction to direct the respondents 1 to 3 to consider his representation dated 16.04.2018 and also to take appropriate action as against the respondents 4 & 5 herein. It is brought to the notice of this Court that the petitioner has filed a private complaint for the same allegation before the learned Judicial Magistrate, Vridhachalam under Section 156(3) Cr.P.C and the same is pending.

4. In view of the above, the prayer sought for by the petitioner in this writ petition cannot be granted. However, the petitioner is permitted to proceed with the private complaint pending before the learned Judicial Magistrate, Vridhachalam.

With the above directions, the writ petition stands disposed of. No costs.
