CR.NO.24 OF 2015 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To relax the bail condition imposed by this Hon'ble Court that once in a week on every Monday at 10.30 a.m. until further orders in CRL.M.P.No.7920 of 2017 in Crl.A.No.360 of 2017 dated 05.07.2017 to once a month on every Monday at 10.30 a.m. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.E.C.RAMESH, Advocate for the petitioner, and of M/S.KRITIKA KAMAL P. Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This is a petition to relax the bail condition, imposed by this Court, by order dated 05.07.2017 in Crl.M.P.No.7920 of 2017 in Crl.A.No.360 of 2017.
2. The petitioner was convicted and sentenced, by judgment dated 20.06.2017 in S.C.No.10 of 2016 on the file of the Sessions Court (Fast Track Mahila Court), Villupuram, challenging which, the petition is before this Court.
3. This Court, by order dated 05.07.2017 in Crl.M.P.No.7920 of 2017 in Crl.A.No.360 of 2017, suspended the sentence and granted bail to the petitioner on several conditions, one of which is that the petitioner shall report before the Trial Court once in a week on every Monday at 10.30 a.m. The present petition has been filed seeking relaxation of the aforesaid condition. https://hcservices.ecourts.gov.in/hcservices/
4. On instructions, the learned Government Advocate (Crl. Side) submitted that the petitioner has been complying the said condition from 24.07.2017.
In view of the above, the aforesaid condition has been relaxed, however, the petitioner shall appear before the Trial Court, at 10.30 a.m., on the first working day of every month until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of their absence, as directed by the trial Court.
