ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 465, 468, 471 of IPC in Crime No.707 of 2025, on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the defacto complainant had rented one of her shop to one Renuka and the petitioner herein the brotherin-law of the said Renuka had created a fabricated rental agreement with a forged sign of the defacto complainant for the said shop. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner is innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that a civil suit is pending between the parties; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and ready to co-operate for the investigation and prayed for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that the investigation is pending and opposed the anticipatory bail to the petitioner. 5.

The learned counsel appearing for the intervener raised strong objection to the anticipatory bail application of the petitioner by stating that the petitioner is in illegal occupation of the defacto complainant's property as if he is a tenant and also not paid even single penny for more than 14 years. He also submitted that the petitioner is misusing and abusing the loopholes in the law, in violation of principles of natural justice and further obtained Interim Orders by using the forged Rental Agreement dated 01.10.2011.

Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsels, the gravity of offence and the fact that the investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner. 3/4
