Respondents Prayer : Petition filed under Article 226 of the constitution of India, to issue a Writ of Mandamum directing the 1st and 2nd respondents to consider the claim of the petitioner as annexed to the writ petition for regularization of service on completion of 10 years of NMR/Casual Labourers services as per G.O.2D.No.29 PWD (C2) Department dated 09.02.2016 on the subject, on the basis of representation dated 08.06.2017 with effect from his initial appointment and within a time to be stipulated by this Hon'ble Court.

O R D E R

The restricted prayer sought for in this writ petition is to consider the claim of the petitioner for regularization of service on completion of 10 years of NMR/Casual Labourers services as per G.O.2D.No.29 Public Works Department (C2) dated 09.02.2016.

2. The learned counsel appearing for the writ petitioner contended that the claim of regularization in respect of similarly placed persons were considered by the Government and the arrears were also paid and the case of the writ petitioner alone is not considered despite the length of services rendered by the writ petitioner.

3. This Court is inclined to consider the grievance of the writ petitioner. Hence, respondents 1 and 2 are directed to consider the representation of the writ petitioner submitted on 8th June 2017 on merits and in accordance with Law, within a period of 12 weeks from the date of copy of this Order.

4. It is needless to state that the claim of the writ petitioner shall be considered provided he is qualified for regularization as per the Rules in force.

5. Accordingly, the writ petition stands disposed of. However, there is no order as to costs.
