Prayer: Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus or any other appropriate writ or order or direction in the nature of Writ of Certiorarified Mandamus calling for the records in respect of the tender issued through website with E-Auction No.NIA.No.02/AE/CCSD1/1/2019-20, with No.66(1)/CCSD 1/1/2019/62, dated 01-05-2019, and quash the same, as which was already given to the petitioner vide Tender No:24 (6)CCD-1/2018-2019/ 2989-99(H), dated 27.12.2018 by the respondents with contract agreement No.46/CCD-1/2018-2019, and Agt.No.47/CCD-1/2018-19 and direct the respondent to give a letter to the petitioner and handover the dismantled material as per their agreement, for renovation of shed opposite to account section for packing material and diluents of vaccine at GMSD, Periamet, Chennai and he has been working since 25 years with respondent department.

The matter was initially listed for hearing on 16.11.2021, there was no representation on behalf of the petitioner, hence the matter was directed to be posted on 22.11.2021. When the matter was taken up for hearing on 22.11.2021, once again there was no representation for the petitioner. In order to give one last opportunity to the petitioner, the matter was directed to be listed on 24.11.2021 under the caption ''For Dismissal'', Even today (i.e.,) 24.11.2021 when the matter is taken up for hearing, once again there is no representation for the petitioner, which clearly shows that the petitioner is not inclined to prosecute the Petition.
