Respondents/ Respondents Writ Appeal filed under Clause 15 of the Letters Patent against the order dated 30.06.2016 passed in M.P.No.2 of 2015 in W.P.No.36838 of 2015 on the file of this Court. Prayer in M.P.No.2 of 2015:

To grant an interim stay of operation of the impugned proceedings issued by the 2nd respondent bearing Memo No. 88345/330/G1/G12/2015-3, dt 11.11.2015.

Writ Petition filed under Article 226 of the Constitution of India Praying for issuance of a Writ of Ceritorarified Mandamus to call for the records relating to Memo No. 88345/330/G1/G12/2015-3 dt 11.11.2015 and to quash the same insofar as the said order grants promotion to the post of JE/ Electrical Grade I to respondents 3 to 32 overlooking the claim of the petitioners and consequently direct the respondents to consider the claim of the petitioners for promotion to the post of Junior Engineer Grade I (Electrical) within a time frame. JUDGMENT

(Delivered by The Hon'ble Acting Chief Justice) The present writ appeal has been filed by the appellants against the interim order passed by the learned Single Judge on 30.06.2016 in M.P.No.2 of 2015 in W.P.No.36838 of 2015 (M.Iruthayaraj and others v. Tamil Nadu Generation and Distribution Corporation Ltd. and others). By the said interim order, the learned Single Judge vacated the interim order and directed that the promotion, if any, made shall remain subject to the final decision in the writ petition. While doing so, the learned Single Judge has referred to the similar order passed in W.A.(MD) No.936 of 2016 by the Madurai Bench of this Court to avoid bringing the process of promotion to a standstill and directed that the promotion, if any, made shall remain subject to the final decision in the writ petition.

2. Having heard the learned counsel for parties, we are satisfied that no interference is required in the said interim order passed by the learned Single Judge allowing the promotion to take place on the basis of the seniority list prepared, while keeping the same subject to the final decision in the writ petition. However, we request the learned Single Judge to decide the writ petition expeditiously.

3. With the above observation, the writ appeal is dismissed. No costs. Consequently, C.M.P.No.15742 of 2016 is closed.
