ORDER

The petitioner apprehends arrest for the alleged offence under Sections 366, 9 5(1) and 6(1) of IPC, the Prohibition of Child Marriage Act 2006, the Protection of Children from Sexual Offences Act, 2012 and The Protection of Children from Sexual Offence Act, 2012, in Crime No.9 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant, who was a minor at the relevant point of time, was allegedly taken by the accused on 29.01.2024 against the wishes of her family. It is further alleged that the accused married her on 07.02.2024 and thereafter subjected her to physical harassment. Based on the complaint, the present case has been registered.

3. There is no representation for the petitioner.

4. The learned Government Advocate (Crl. Side) for the respondent police submitted that the victim is aged about 17 years. He further submitted that the statement of the minor victim girl has been recorded under Section 183 of BNSS, wherein she has stated that she was in a relationship with the petitioner and has also made serious allegations against him. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Considering the seriousness of the allegations and also considering the statement recorded under Section 183 of BNSS, from the minor victim girl, this Court is of the firm view, that this Court is not inclined to enlarge the petitioner on anticipatory bail.

6. Accordingly, this Criminal Original Petition stands dismissed. 15-04-2026 DRL To 1.The Public Prosecutor, High Court, Madras.
