These petitions have been filed seeking to condone the delay of 11 days in filing the above Second Appeals against the judgment and decree dated 14.12.2023 passed in A.S.Nos.38 and 39 of 2022, on the file of I Addl. District Court at Namakkal confirming the judgment and decree passed in O.S.No.307 of 2021 dated 03.03.2022 on the file of Principal Subordinate Court, Namakkal.

2. Mr.S.Senthil, learned counsel for appellants submitted that due to illness, the appellants were not able to contact their counsel within a stipulated time. Hence, there is a delay of 11 days in filing the above second appeals arose, which is neither willful nor wanton. Therefore, he filed these petitions to condone the delay in filing the above second appeals.

3. Considering the facts and circumstances, and the reasons stated by the petitioners in the affidavit is justifiable one. Accordingly, this court is inclined to allow these petitions. Registry is directed to number the Second Appeal if it is otherwise found to be in order and post the matter on 21.06.2024.
