A.No.2473 of 2020 in C.S.No.830 of 2018 A.No.2473 of 2020 in C.S.No.830 of 2018 C.V.KARTHIKEYAN J, This application actually follows the order passed in A.No.752 of 2020 which was ordered on 20.02.2020. In that application, a learned Single Judge had directed that the amount deposited by the defendant pursuant to orders of the Court is liable to be returned to the defendant and had allowed the application. The Registry was directed to foreclose the Fixed Deposit in Indian Bank, Madras High Court Branch standing to the credit of the suit account and pay the same to the defendant.
2. By the present application, the defendant is now qualified and it is stated that the owner of the Vessel M.T.Desh is M/s.Shipping Corporation of India Limited. The learned counsel therefore states that the Registry must be directed to issue the cheque in the name of M/s.Shipping Corporation of India Limited.
3. Heard the learned counsel for the plaintiff who also affirms to that fact.

In view of the same, the Registry may, pursuant to the orders already passed in A.No.752 of 2020, issue the cheque for the amount which has been foreclosed and in now lying in Indian Bank, Madras High Court Branch to the credit of C.S.No.830 of 2018 in the name of "M/s.Shipping Corporation of India Limited". The cheque may be issued to the counsel / authorised representative of M/s.Shipping Corporation India Limited on due authorization / acknowledgement and any necessary undertaking if required.
