A.No.3748 of 2023 in C.S.DR.No.35252 of 2023 R.N.MANJULA,J.

This application has been filed by the applicant / plaintiff to sue the 1st and 4th defendants, who are carrying on business outside the jurisdiction of this Court.

2. The suit has been filed by the applicant / plaintiff to direct the defendants to jointly and severally pay the sum of Rs.52,44,384/- equivalent to 13,844.94 MT of coal as on the date of the misappropriation and supply of the goods by the defendants herein along with the interest at the rate of 24% per annum calculated on monthly rest from the date of filing this plaint till its realization and to direct the defendants to jointly and severally pay a sum of Rs.2,00,00,000/- as compensation for the damages, mental agony and hardship suffered by plaintiff for their malafide acts as mentioned in the plaint.

3. According to the learned counsel for the applicant / plaintiff that the suit has been filed for recovery of money and for damages against the defendants. Even though the cause of action is well within the jurisdiction of this Court, the defendants 1 & 4 are living outside the jurisdiction of this Court and hence, this leave application is filed. https://www.mhc.tn.gov.in/judis
