ORDER : The Court Made the following order :- The petitioner who was arrested on 03.07.2021 and remanded to judicial custody for the alleged offence under Sections 304(ii) of IPC read with Section 135 (i)(e) of Tamil Nadu Electricity Act, 2003 in Cr.No.433 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 02.07.2021, while crossing the agricultural land belongs to one Seenu Naidu, which has been cultivating by on Veerasamy for the past 11 years, the deceased met in the electric fence, which has been illegally laid in the field by the accused.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. The deceased was died in some other place and his dead body has been thrown in the petitioner's field. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Crl. side) submitted that the petitioner put up electric fence in his agricultural land without getting any permission from TNEB. Due to which, one Elumalai, aged about 60 years, met the accident while crossing the petitioner's land and lost his life. The investigation is pending. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration the allegations and also the fact that the case is in the initial stage of the investigation and considering the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
