Contempt petition filed under Section 11 of Contempt

of Courts Act, praying to punish the respondents under Section 11 of Contempt of Courts Act, 1971 for willfully deliberately violating the orders dated 12.09.2005 made in Review No.55 of 2005 in W.P.No.3095 of 2005 of this Hon'ble Court.

ORDER

This contempt petition is filed alleging willful disobedience of the order dated 12.09.2005 and made in Review No.55 of 2005 in W.P.No.3095 of 2005.

2.Learned counsel appearing for the petitioners is absent. Mr.V.Subbiah, learned Special Government Pleader on written instructions from Mr.K.J.Johnchristoper, Tahsildar, Erode would submit that the Revenue Authorities/ respondents have completed their work as per the undertaking filed by them in W.P.No.3095 of 2005, but the writ petitioners/ encroachers are not willing to move to the new place assigned to them.

3.In the light of the same, this Court is of the view that no contempt has been made out. Accordingly, this contempt petition is closed.

The letter of Mr.K.J.Johnchristoper, Tahsildar, Erode dated 05.06.2015 addressed to the Special Government Pleader is placed on record.
