Challenging the fair and decretal order passed in I.A.No.7 of 2024 in O.S.No.464 of 2015 on the file of the District Munsif Court, Dharapuram, the revision petitioner/5th defendant has filed this Civil Revision Petition.

2. The said Interlocutory Application was filed by the respondents/plaintiffs under Order VII Rule 14(3) CPC seeking leave to receive additional documents.

3. The learned counsel for the revision petitioner/5th defendant submitted that the Trial Court has erroneously allowed the application without assigning proper reasons. According to him, the documents sought to 2/6

be produced were admittedly available much earlier and pertain to a period nearly 8 years prior to filing of the application, and no satisfactory explanation has been offered for the inordinate delay. It is further submitted that the application has been filed at a belated stage, when the suit is pending at the stage of cross-examination of PW1, and therefore, the impugned order warrants interference.

Per contra, the learned counsel for the respondents/plaintiffs submitted that the documents are vital for proper adjudication of the dispute and that they could not be produced earlier as they were mixed up with other documents and were traced only recently. It is further submitted that the delay was neither wilful nor wanton and the Trial Court, taking note of the same, has rightly exercised its discretion in allowing the application.

5. This Court has considered the submissions made on either side and perused the materials available on record.

6. A perusal of the impugned order would show that the Trial Court has taken into consideration the reasons assigned by the plaintiffs and, applying the principles of natural justice, has granted an opportunity to produce the 3/6

additional documents, subject to proof and relevancy. The Trial Court has also imposed costs while allowing the application.

It is well settled that while exercising jurisdiction under Article 227 of the Constitution of India, this Court would not interfere with discretionary orders passed by the Trial Court unless the same suffer from perversity or patent illegality. In the present case, this Court does not find any such infirmity in the order passed by the Trial Court warranting interference.

8. However, it is made clear that the reception of additional documents shall not prejudice the rights of the revision petitioner/5th defendant and he is at liberty to raise all objections with regard to admissibility, genuineness and relevancy of the documents at the time of trial.

9. The respondents/plaintiffs are directed to furnish copies of the additional documents to the revision petitioner/5th defendant, if not already furnished.

10. Considering the fact that the suit is of the year 2015 and is pending at the stage of cross-examination of PW1, the Trial Court is directed to 4/6

dispose of the suit as expeditiously as possible.

11. With the above observations, this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
