BASKARAN CRIMINAL MISCELLANEOUS PETITION No.3358 and 3359 of 2017 IN CRL A.338/2016 V.RAJENDRAN [ PETITIONER IN CRL.MP.3358/2017] K.GOVINDASAMY [ PETITIONER IN CRL.MP.3359/2017] Vs THE STATE OF TAMIL NADU [ RESPONDENT ] DEPUTY SUPERINTENDENT OF POLICE, VIGILANCE AND ANTI CORRUPTION, KRISHNAGIRI DISTRICT.

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed in Crl.M.P.Nos.5141 & 5142 /2016 in Crl.A.No.338/2016 dated 28-04-2016 on the file of this Honble Court.[IN CRL.MP.NOS.3358 & 3359/2017] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.SELVI GEORGE Advocate for the petitioner and of MR.E.RAJA PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- These petitions are filed seeking to relax the condition imposed on the petitioners/appellants.

2. It is stated in the affidavits filed in support of the petitions that the petitioners have been appearing regularly before the learned Special Judge / Chief Judicial Magistrate, Krishnagiri on the first working day of every month, as per the order of this Court dated 28.04.2016 in Crl.M.P.Nos.5141 & 5142 of 2016 in Crl.A.No.338 of 2016 and complied with the conditions regularly. Now, the petitioners have come up with the present petitions to relax the said condition.

3. Heard Mr.E.Raja, learned Additional Public Prosecutor, appearing for the respondent-State on the above submissions.

4. Considering the reasons stated in the petitions, these petitions are allowed and the conditions imposed in Crl.M.P.Nos.5141 & 5142 of 2016 in Crl.A.No.338 of 2016 is modified to the effect that the petitioners shall appear before the said court on the first working day once in three months at 10.30 a.m, until further orders.

5. Petitions are ordered accordingly.
