ANAND VENKATESH CRIMINAL MISCELLANEOUS PETITION No.6568 of 2019 in Crl.RC.No.432 of 2019 V.SUDHAKARAN [ PETITIONER ] Vs M.RAJAA [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Revision Case No.432 of 2019 on the file of the High Court, the High Court will be pleased to exemption to surrender of the petitioner and accept his surety before the learned Fast Track court Judicial Magistrate II at Poonamallee STC No.14 of 2017 order dated 24.04.2018 which was confirmed the sentence by the Learned II Additional District and Sessions Judge, Thiruvallur at Poonamallee dated 23.04.2019 in Crl.A.No.77 of 2018.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Revision Case No.432 of 2019 on the file of the High Court and upon hearing the arguments of M/S.P.KUMARESAN, Advocate for the petitioner the court made the following order:- This Criminal Miscellaneous petition has been filed to exempt the petitioner from surrendering and to accept the surety in pursuant to the judgement passed by the learned Fast Track Court Judicial Magistrate II, Poonamallee, confirmed by the learned II Additional District and Sessions Judge, Tiruvallur at Poonamallee in Crl.A.No.77 of 2018.

This petition is closed, since suspension of sentence can be granted even if the accused has not surrendered and is not undergoing confinement as per the Judgement of this Court reported in 2008 1 MLJ Crl 1001 [R.Ramamoorthy Vs. The Inspector of Police, Crime Branch, Erode].
