ORDER

This Criminal Original Petition has been filed, seeking a direction to direct the 3rd respondent not to harass the petitioner under the guise of enquiry.

2. Today, when the matter was taken up for consideration, the learned Additional Public Prosecutor (Criminal Side) appearing for respondents 1 to 3, on instructions, submitted that based on the complaint given by the petitioner's grandmother, an enquiry was conducted by the respondent Police. During the course of enquiry, it was found that there exists a dispute with regard to the receipt of rent in respect of the property in question, which is purely civil in nature and is pending adjudication before the competent civil court. Further, he submitted that the petitioner has given an undertaking that he will not create any issue, and that the respondent police officials are not unnecessarily harassing the petitioner and he was summoned only for the purpose of enquiry.

3. In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioner for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and co-operate in the investigation. It is made clear that the petitioner shall not be harassed during the course of enquiry. If any cognizable offence is made out, the respondent police shall register a First Information Report and proceed in accordance with law.

4. With the above direction, this criminal original petition stands disposed of.
