Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the 1st respondent to dispose of the Appeal No.232/2016 filed by the petitioner against the order dated 29.05.2015 passed by the 2nd respondent in Na.Ka.No.2453/2013/AA1 within the time stipulated by this Court.

ORDER

Heard the learned counsel for the petitioner and Mr.A.N.Thambi Durai, learned Special Government Pleader who accepts notice on

behalf of the respondents.

The petitioner's case is that he purchased the schedule mentioned property through a registered Sale Deed bearing Document No.1993/1989 dated 29.07.1989, registered on the file of the Sub Registrar, Thiruporur and was in absolute possession and enjoyment of the same. The petitioner applied for issuance of patta on 13.06.2013 to the 2nd respondent and the 2nd respondent vide order dated 29.05.2015, rejected the petitioner's claim, pursuant to which, the petitioner has preferred an appeal before the 1st respondent in Appeal No.232/2016. It is the grievance of the petitioner that though the said appeal was filed as early as in November 2015 and got numbered subsequently, the same is pending consideration on the file of the 1st respondent and hence, the petitioner has approached this Court seeking a direction upon the 1st respondent to dispose of the said representation.

Taking into consideration the limited scope of prayer sought for by the petitioner, this Court, in view of the above facts and circumstances and without going into the merits of the claim projected

by the petitioner either in this writ petition or in the appeal, directs the 1st respondent to consider and dispose of the petitioner's appeal in Appeal No.232/2016 on merits and in accordance with law and pass orders as expeditiously as possible and communicate the decision taken, to the petitioner.

The writ petition is disposed of with the above direction. No costs.
