Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the respondents to revoke the order of suspension passed by the 2nd respondent in proceedings No.1242/A1/2023-1 dated 24.02.2023 and reinstate the petitioner in service, by considering petitioner representation dated 11.09.2023 and 27.03.2024. ORDER

This writ petition has been filed in the nature of a mandamus seeking a direction against the respondents to revoke the order of suspension passed by the second respondent on 24.02.2023 and to reinstate the petitioner. The petitioner had given a representation on 11.09.2023 and again on 27.03.2024.

2. In the affidavit filed in support of the writ petition, it had been stated that the petitioner had been initially recruited as Junior Assistant on 16.03.1989 and posted in the Registration Department and after promotion posted as Sub Registrar, Chits and Society at Erode. On 22.02.2023, Vigilance and AntiCorruption Department at Erode had registered FIR in Crime No.3/AC/2023 against the petitioner and another individual for offences punishable under Section 7(a) of Prevention of Corruption Act, 1988. The petitioner was remanded to the judicial custody on 22.02.2023 and was granted bail on 17.03.2023. The petitioner had been placed under suspension.

3. It is contended that subsistence allowance is being paid to the petitioner. However, the investigation has not yet been completed. The charge memo has not yet been issued. The petitioner had therefore, given a representation seeking revocation of the order of suspension.

4. The learned Government Advocate appearing for the respondents stated that the second respondent would examine the representation in its proper manner and take into consideration all the surrounding factors and pass orders.

5. A direction is issued that necessary orders should be passed by the first respondent within a period of eight weeks from the date of receipt of a copy of this order. The Writ Petition stands disposed of. No costs. 24-04-2025 nl Index:Yes/No
