Criminal Original Petition is filed under Section 482 of Cr.P.C. to direct the respondent to provide police protection in case of parents or relatives of the petitioner have filed any false case or cause any harassment to the petitioner while their stay at her husband house at Balamanallur, Marikampatty. ORDER
This Criminal Original Petition has been filed seeking for police protection.
2. The petitioner, who is aged about 19 years has married one Manoj @ Manojkumar, who belongs to the same village. The marriage was an inter caste marriage and this was opposed by the parents of the petitioner. A complaint was given to the respondent police stating that the petitioner and the family members of her husband are being harassed. That apart, there is also a potential danger to the life and limb of the petitioner and her husband and his parents and therefore police protection is being sought for by the petitioner.
3. The learned counsel for the petitioner submitted that the petitioner is peacefully living in the matrimonial https://hcservices.ecourts.gov.in/hcservices/
home. However, the parents of the petitioner are causing serious threat to the petitioner and therefore, the petitioner has approached this Court seeking for police protection.
4. The learned Additional Public Prosecutor submitted that a representation has been received from the petitioner and an enquiry will be conducted and an appropriate decision will be taken by the respondent police.
5. Taking into consideration the facts and circumstances of the case, there shall be a direction to the respondent police to call the parents of the petitioner for an enquiry and inform them not to interfere with the life of the petitioner, who is a major and who has taken a decision to marry the above said Manoj. Admittedly, the parents of the boy have agreed for this marriage. If the marriage is not to the liking of the parents of the petitioner, that does not give them a right to take law into their own hands. If, in spite of the advise, there is interference, the respondent police shall take appropriate action in accordance with law and if necessary, police protection may also be given to the petitioner and her family.
6. This Criminal Original Petition is disposed of with the above directions.
