CRIME NO.104 OF 2017 Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL A.No.309 of 2019 on the file of the High Court, the High Court will be pleased to suspend the sentence dated 08.02.2019 passed in SCC No.48 of 2017 against the appellant on the file of the Mahila Court (Fast Track), Dharmapuri, enlarge him on bail pending disposal of the above CRL A.No.309 of 2019 Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL A.No.309 of 2019 on the file of the High Court and upon hearing the arguments of M/S.BHARATHI RAJA J., Advocate for the petitioner, and of M/S.KRITIKA KAMAL .P Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- The petitioner tried in Special S.C.No.48 of 2017 by the Sessions Judge, Fast Track Mahila Court, Dharmapuri, and was convicted and sentenced on 08.02.2019 to undergo 7 years Rigorous Imprisonment under Section 5(I) r/w 6 of the POCSO Act, 2012.

2. While so, the petitioner has filed the present Criminal Miscellaneous Petition seeking suspension of sentence and bail.

3. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondent.

4. It is seen that the victim girl was 13 years old and the petitioner was 22 years old at the time of the incident. The victim girl has clearly stated that the petitioner had taken her to various https://hcservices.ecourts.gov.in/hcservices/

places and had sex with her. Thus, there are prima facie materials to show that the judgment of the Trial Court does not suffer from serious infirmity. Hence, this Criminal Miscellaneous Petition is dismissed.
