Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, forbearing the 1st respondent in anyway awarding lease to the 2nd respondent in respect of Item No.6 of lease cum Public Auction Notification issued by the 1st respondent in Na.Ka.No.3494/2017/m1, dated 21.11.2017 and consequently direct the 1st respondent to confirm the auction and issue lease right of collecting toll fee for the tourists vehicles to the petitioner within the period stipulated by this Court.

O R D E R

The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this writ petition, with liberty to challenge the issuance of licence to the second respondent for Item No.6, as per the tender notification dated 09.12.2017. He also made an endorsement to that effect.

2. In the light of the submission and endorsement made by the learned counsel appearing for the petitioner, liberty is granted and this writ petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
