O R D E R
This writ petition has been filed challenging the proceedings of the 1st respondent dated 20.11.2023 and for a consequential direction to promote the petitioner and to grant him other attendant and monetary benefits.
2.When the matter came up for hearing on 05.08.2024, this Court passed the following order:
"Mr.David Sundar Singh, learned standing counsel, takes notice on behalf of respondents 1 to 3.
2.The petitioner has challenged the impugned order passed by the 1st respondent dated 20.11.2023, mainly on the ground that the 1st respondent had taken into consideration only the punishment that was imposed for the first charge and there is absolutely no mention about the punishment that was imposed for the 2nd 2/5
charge against the petitioner.
3.The 1st respondent while considering the mercy petition has reduced the punishment of stoppage of next annual increment for three years without cumulative effect to stoppage of next annual increment for one year without cumulative effect. According to the petitioner, there is no clarity as to whether this order passed by the 1st respondent covers the 2nd charge also, which arose out of a separate incident and for which a separate punishment was imposed.
4.The learned Standing counsel shall take instructions in this regard and make her submissions.
5.Post this case under the caption for orders on 23.08.2024."
3.When the matter was taken up for hearing today, the learned Standing Counsel appearing on behalf of the respondents submitted that the order passed by the 1st respondent covers the second charge also. 4.In the light of the above clarity given by the learned Standing Counsel, the same is recorded and no further orders are required to be passed in this writ petition.
5.Accordingly, this Writ Petition is disposed of. No costs. 3/5
