ORDER

The criminal original petition has been filed to direct the Principal District and Sessions Judge, Tirupattur to consider the bail application of the petitioners on the same day of his surrender in Cr.No.18/2026 on the file of the respondent police 2.Heard the learned counsel appearing for the petitioners as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

Considering the submissions made and upon perusal of the materials on record, it is seen that on 15.01.2026 at about 5:00 p.m., the petitioners, along with the other accused, were allegedly consuming alcohol in a public ground. At that time, the son of the third respondent, namely Harish, had gone to play cricket near the Perumal Temple Ground. It is alleged that the petitioners, along

with the co-accused, assaulted the said Harish. Thereafter, when the defacto complainant along with his relative questioned the petitioners and the coaccused, the petitioners are alleged to have abused the third respondent using his community/caste and further assaulted them using cricket stumps. The third respondent is stated to have sustained injuries and was taken to the hospital for treatment.

4. Heard the learned counsel for the petitioners and learned Additional Public Prosecutor appearing for respondents 1 and 2 and perused the materials available on record.

5. It is the case of the petitioners that the petitioners along with the coaccused, were present near the Perumal Koil on the date of the alleged occurrence. A wordy quarrel arose between the defacto complainant's son and his friends while they were playing cricket. The petitioners and their friends intervened only with an intention to pacify and resolve the dispute. Without ascertaining the true facts, the third respondent, along with others, allegedly came to the spot, abused the petitioners and their friends, and attempted to

assault them. The learned counsel for the petitioners further submitted that A1 and A2 were arrested and later released on bail by this Court on 10.02.2026, and A9 was granted anticipatory bail. It is also submitted that the petitioner was discharged from the hospital on 17.01.2026.

6.In view of the above factual position, there shall be a direction to the the Principal District and Sessions Judge, Tirupattur, to consider the petitioners' bail application, preferably on the same day of his surrender, in connection with Crime No.18 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
