ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the District Collector, Thiruvallur District, Thiruvallur / the respondent herein to fix and determine the value of the building standing and pay compensation for the lands comprised in Survey No.411, measuring an extent of 100 sq. meters,situated at No.82, Panapakkam Village, Uthukottai Taluk and consequently disburse the compensation together with all applicable statutory benefits within a time frame.

The learned counsel appearing for the petitioner would submit that the petitioner's land in Survey No.411 situated at No.82, Panapakkam Village, Uthukottai Taluk, measuring an extent of 100 Sq.mtrs was acquired for the purpose of formation of Kosasthalai River Bridge - Puttur Road (conversion from two-land to four-lane project). He would further submit that while passing the award, the land alone was taken into consideration for determining the compensation and accordingly, the compensation was fixed. However, there was a building in the subject land and the same was not at all considered while determining compensation. Therefore, the petitioner has given a representation. In response to the representation, the Tahsildar sent a letter dated 18.05.2017 wherein, it is stated that the petitioner's request to determine the compensation for building will be considered. However, till date, no steps have been taken to re-determine the compensation. Hence, the present writ petition is filed.

3. Per contra, learned Government Advocate appearing for the respondent would submit that in the present case, in the event if no valuation fixed and building was left out while determining the compensation, the same will be considered and appropriate additional compensation will be fixed.

4. I have considered the submissions made by the learned counsel for the petitioner as well as the respondent.

Upon perusal of the petitioner's affidavit and hearing the submissions of the learned counsel for the respective parties and particularly, the Tahsildar's letter dated 18.05.2017, it appears that no compensation was fixed for the building. The compensation was fixed for the land alone. Such being the case, the petitioner is entitled for the compensation for the building as well.

In such view of the matter, this Court directs the respondent to pass appropriate orders / award, fixing the compensation for the building standing in the subject land, which was acquired, within a period of four months from the date of receipt of a copy of this order, after due notice to the petitioner.
