Writ Petition filed under Article 226 of the Constitution of India praying Writ of Mandamus, directing the 2nd Respondents to evaluate the Diploma in Teacher Education Certificates of the students of the Petitioner College by considering and passing orders on the representation of the petitioner dated 5.11.2019 within a stipulated period. ORDER

The present petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd Respondent to evaluate the Diploma in Teacher Education Certificates of the students of the petitioner College pursuant to the petitioner's representation dated 05.11.2019.

2. The case of the petitioners is that the petitioners 1 & 2 are the colleges affiliated to the 3rd petitioner herein and the petitioner's Colleges were given permission to conduct Diploma

in Teacher Education D.T.Ed. Courses in the 2000. After completing their courses in Diploma in Teacher Education, students of the said colleges both from Tamil Nadu and Kerala have obtained appropriate certificates from the 3rd petitioner. Thereafter, they were permitted to register their qualifications with their respective District Employment Exchange in Tamil Nadu by the orders of this Court. Subsequently, the students have also obtained appointment orders in different departments from their respective Governments. Thereafter, the petitioners herein approached the respondents to evaluate the certificates in terms of the earlier orders of this Court in W.P.Nos.25495 & 24597 of 2004 for which no steps were taken by the respondents. The petitioners made a representation dated 05.11.2019 to the respondents requesting to evaluate the Diploma in Teacher Education Certificate awarded to the students by the 3rd petitioner. However, till date, no action has been taken on the same. Hence, the present Writ Petition is filed seeking the above relief.

Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court issues direction to the respondents to consider the petitioner's representation dated 05.11.2019 and pass appropriate orders on the same within the time frame fixed by this Court.

A counter has been filed by the 2nd Respondent stating that the Diploma in Teacher Training Certificates issued by the 3rd petitioner herein could not be evaluated, since the 3rd respondent institute is not a recognized institute to impart Teacher Training Education either by the Southern Regional Educational Council or by the Northern Regional Educational Council. Such being the case, the petitioner has no legal or statutory right to seek for evaluation of the certificates issued by the said institute. Therefore, the present petition is liable to be dismissed.

Though contentions and counter contentions have been advanced, however, in view of the limited relief sought for by the petitioner, this Court without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 05.11.2019 and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is disposed of with the aforesaid direction. No costs. Consequently, the connected Miscellaneous Petition is closed.
