This second appeal has been filed under Section 100 of Code of Civil Procedure against the judgment and decree dated 05.12.2001 and made in A.S.No.110 of 2000 on the file of the Principal District Judge, Coimbatore, reversing the Judgment and Decree dated 29.11.1999 and made in O.S.No.1739 of 1996 on the file of the Second Additional District Munsif Court, Coimbatore.

The learned counsel for the respondent reported that already this case was posted under the "dismissal" caption for several times.

2. A perusal of the records shows that either there was no representation for the appellant or the appellant's counsel was not ready for arguments. Even today, there was no representation for the appellant inspite of that the case is posted under the caption "for dismissal". Under these circumstances, there is no other go for this court except to dismiss the second appeal. Therefore, the second appeal is dismissed for non-prosecution. No order as to costs.
