The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondents to provide the petitioner any alternate job with the pay protection and service benefits and also to pay wages from the date of denial of duty that is 18.10.2024 to till rejoining as per the provisions of Rights of Persons with Disabilities Act 2016.
2. The learned counsel for the petitioner would submit that after he diagnosed with Optic Neuritis on both eyes, he was allotted with light duty. However, from 18.10.2024, he was not allotted with any duty. It is the further submission of the petitioner that he has been in out of employment for the past 8 months. In this connection, he has given a representation dated 25.03.2025 to the respondents.
3. The learned Standing Counsel appearing for the respondents would fairly submit that they would consider the petitioner's representation, within a reasonable time.
4. In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider 2/4
the petitioner's representation dated 25.03.2025 and pass order on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
