Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to remove all the encroachments made in the Car Streets and around the Arulmighu Pathrakaliamman Thirukoil situated at Mechery, Mettur Taluk, Salem District for conducting Temple Car trail to be conducted

on 22.02.2015 and subsequently for celebrating Great Temple Car Festival in the respondent temple.

O R D E R

(Made by The Hon'ble The Chief Justice) We have perused the affidavits filed which state that with the police assistance and cooperation of the encroachers, the encroachments made in the Car Streets and around the Temple have been removed. Of course, the affidavits are silent as to how these at all occurred. As usual, there is no endeavour to fix responsibility by the Government on anybody in not performing his duties. Much as we would, we cannot improve the functioning of the Government in these matters

2. We direct that the encroachments removed should not be permitted to arise again and the Revenue Divisional Officer and the Tahsildar shall be responsible to ensure due compliance of these directions, so that such problem does not crop up.

3. The petition stands disposed of with the aforesaid directions. No costs.
