ORDER

The petitioner is an accused in Cr.No.342 of 2025 registered for an offence under Section 296 (b), 115 (2) 118 (1) and 351 (3) of BNS, 2023. Counter complaint was lodged by the petitioner herein in Cr.No.341 of 2025 for the aforementioned offences as against 1.Vijayakumar, 2.Surya, 3.Parthiban. Thereafter, no action has been taken by the respondent - Police. Hence, the petitioner had filed this transfer petition to transfer the investigation.

2. The learned counsel for Government of Tamilnadu opposes the contentions of the petitioner and filed a status report. From the status report it can be seen that based on the complaint, a case was registered at Kandhili Police Station in Crime No.341 of 2025 against the accused persons on 14.12.2025 at about 02.00 hours. During the course of investigation, the then Inspector of Police visited the place of occurrence and prepared observation mahazar and rough sketch in the presence of witnesses and also examined the witnesses and recorded their statements. The accused persons, viz., Vijayakumar, Surya and Parthiban have filed anticipatory bail petition before the District Sessions Judge, Tirupattur and the same was granted on 23.01.2026. Subsequently, a counter case was filed in Crime No.342 of 2025 as against Devaraj, Vinothkumar, Sathish and Vignesh. The anticipatory bail petition filed by the above said persons were also granted on 30.12.2025. He further

submitted that the investigation is being conducted in a free and fair manner, following the Police Standing Orders and soon final report will be filed in both the cases.

3. Recording the submissions made by the learned counsel for the respondent and taking note of the status report filed by the respondent police, this Criminal Original Petition stands disposed of. Consequently the connected miscellaneous petition is closed.
