O R D E R

This petition has been filed to relax the condition imposed by this Court in Crl.O.P.No.1841 of 2023 dated 02.02.2023 that the petitioner shall report before the respondent police on every Tuesday at 10.30 a.m. till the completion of trial.

2.The contention of the learned counsel for petitioner is that the petitioner filed a bail application in Crl.O.P.No.1841 of 2023 before this Court and this Court, by the order dated 02.02.2023, granted bail with certain conditions. One of the condition is that the petitioner to report before the respondent police on every Tuesday at 10.30 a.m. till the completion of trial. The further contention of the learned counsel for petitioner is that now trial has reached penultimate stage, Investigating Officer alone to be examined and due to the above condition, the petitioner is unable to carry on with his regular work and prepare for his effective defence. 2/4

3.The learned Government Advocate appearing for the respondent police submitted that the petitioner is involved in cheating to the tune of Rs.19,63,000/-. If any relief is granted to the petitioner, he will be absconded and the trial would be stalled.

4.The learned counsel for the petitioner submitted that the petitioner will appear before the trial Court on future hearing dates and he will not be a reason for stalling of the trial. He also submitted that in this case the petitioner cross examined all the witnesses so far. 5.In view of the same, this Court is inclined to relax the condition. Accordingly, the condition imposed on the petitioner to report before the respondent police on every Tuesday at 10.30 a.m. till the completion of trial, is hereby totally relaxed.
