This petition is filed to condone the delay of 46 days in filing the above appeal.

2.Mr.T.M.Karthikeyan, the learned counsel, who takes notice for the respondents 1 to 3 and Mrs.I.Malar, the learned counsel appearing for the 5th respondent, have submitted that the respondents 1 to 3 and 5th respondent have no objection in allowing the petition.

3.The learned counsel appearing for the petitioner submitted that the 4th respondent remained exparte before the Tribunal and hence, notice to the 4th respondent is not necessary.

4.Recording the no objection given by the learned counsel appearing for the respondents 1 to 3 and 5th respondent and being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 46 days is condoned and the petition is ordered.
