ORDER

This Writ Petition has been filed challenging the order passed by the second respondent dated 13.06.2018, thereby rejected the request made by the petitioner seeking issuance of patta for the land comprised in Survey Nos.114/2, 114/3, 114/25 and 114/37, situated at Agarampallipattu Village, Thandarampattu Taluk, Tiruvannamalai District.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner belongs to the Adi Dravidar community. The land comprised in Survey Nos.114/2, 114/3, 114/25 and 114/37, situated at Agarampallipattu Village, Thandarampattu Taluk, Tiruvannamalai District, is in possession and enjoyment of the petitioner for the past several years. In order to obtain a patta, the petitioner

submitted an application for the subject lands. Thereafter, there was a dispute between the petitioner and the third respondent herein, who is none other than her own brother, in respect of the subject property. On inspection, the first respondent cancelled the adangal, wherein it is stated that "Cancel B memo, reverse this for common purpose".

A perusal of the counter affidavit filed by the second respondent and also the submissions made by the learned Additional Government Pleader reveal that the petitioner is working as an Assistant in the Animal Husbandry Department in Vanapuram Village, Thandarampattu Taluk. The petitioner's husband, viz., Sakkarai, is working as a part time teacher in the Government Middle School. That apart, the petitioner owned lands comprised in Survey No.115/2D, to an extent of 25.5 cents, survey No.119/1D, to an extent of 21 cents and Survey No.119/16 to an extent of 50.5 cents, in total 97 cents in Agarampallipattu Village, Thandarampattu Taluk, Tiruvannamalai District.

5. That apart, a perusal of the report submitted by the first respondent reveals that there is no evidence to show that the petitioner is

cultivating the subject land, which is lying Karambu (unused). The petitioner has not taken any step to convert the said Karambu land into cultivable agricultural land. Therefore, the request made by the petitioner was rightly rejected by the second respondent.

6. In view of the above, this Court finds no infirmity or illegality in the order 13.06.2018 passed by the second respondent. Thus, the writ petition lacks merits and is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. Consequently, connected miscellaneous petition is closed. No costs.
