The present criminal original petition has been filed seeking a direction to the first respondent to transfer the investigation in Cr.No.855 of 2015 on the file of the fourth respondent police to the second respondent police under the periodic monitoring of this Court.

2. The petitioner lodged a complaint as against one Karthikeyan, Sai and Rathnapandian. for the alleged offence under sections 294(b), 324, and 506(i) IPC before respondent police. The same was registered in Crime No.855/2015 on the file of the respondent police. But till date, no action was taken. Hence, the present petition.

3. When the matter was taken up for consideration, learned Additional Public Prosecutor submitted that on completion of investigation, the charge sheet has been filed as 'mistake of fact' and RCS notice has also been served on the petitioner.

4. Since the referred charge sheet was filed, there is no need to transfer the investigation. Hence, the criminal original petition stands dismissed. However, the petitioner is at liberty to file a protest petition before the concerned Magistrate.
