C.M.P.No.5746 of 2006 in C.R.P.No.2122 of 2001 T. MATHIVANAN.J., This petition has been filed under Section 5 of Limitation Act, praying to condone the delay of 242 days in filing the restoration petition.

2. Ms.N.Mala, learned counsel appearing for the petitioner is present. Mr.N.E.Arumugam, learned counsel is on record for the first respondent and Mr.G.Shanmugam,learned counsel is on record for R4. In respect of R2 and R3, notice was dispensed with. However, there is no representation for R1 and R4.

3. Considering the averments made in the affidavit filed in support of the petition, this petition is allowed.

4. Ms.N.Mala, learned counsel appearing for the petitioner has submitted that Mr.N.E.Arumugam, learned counsel appearing for the first respondent is no more now.

5. Hence, the Registry is directed to verify the fact as to whether any learned counsel has entered appearance on behalf of the first respondent or not? and number the restoration petition, if filed and list the matter on 05.08.2016. 21.07.2016 nvi
