2. Heard both sides and perused the materials available on record.

3. The learned counsel appearing for the respondent/defendant has no serious objection for allowing this application.

4. Though this Court is not satisfied with the reasons stated in the affidavit filed in support of this application, however, in order to give an opportunity to the applicant/plaintiff to raise his defence, the delay is condoned.

5. Accordingly, this application is allowed.

6. Registry is directed to take the plaint on file, if it is otherwise in order.
