This petition for quash both on the merits and on limitation. 2.The learned Additional Public Prosecutor however states that the offences are under 147, 148, 294(b), 323, 324 and 506(ii) of IPC. The complaint is not barred by limitation. The final report is ready and soon it will be filed.

3.The respondent police before filing the final report shall ensure whether the prosecution against the petitioner and taking of cognizance are barred by limitation. In otherwise, before taking cognizance the learned Magistrate shall look into the material placed and thereafter, take complaint on file.
